The Opportunity

 

Boutwell Fay LLP is seeking ERISA/Employee Benefits Attorney candidates with a minimum of four years of legal or relevant industry experience in the ERISA/employee benefits and executive compensation area. Our ideal candidates are proficient in handling client inquiries and are adept at simplifying complex issues.

 

Qualifications

 

We are seeking candidates with experience in one or more of the following areas:

 

  • Experience representing and advising employers concerning their retirement and welfare benefit plans with respect to all ERISA and Internal Revenue Code matters.

  • Experience with qualified defined contribution and defined benefit retirement plans.

  • Strong knowledge of ERISA, the Internal Revenue Code, and related regulatory frameworks, including IRS and DOL voluntary correction programs

  • Experience with nonqualified deferred compensation plans, equity compensation, and retention programs.

  • Experience with employee benefit plans and compensation arrangements in mergers and acquisitions.

  • Experience with health and welfare benefit plans.

  • Experience drafting plan documents and summary plan descriptions, negotiating service provider contracts, and reviewing investment management agreements.

  • Ability to counsel plan sponsors and fiduciaries on compliance requirements and fiduciary best practices, with a focus on plan governance.

  • Experience working with the employee benefit plans of non-profit organizations, including 403(b) plans, 457(b) plans, and 457(f) plans.

  • Experience working with governmental and church employee benefit plans.

  • Familiarity with investment products used to fund retirement plans, including annuity contracts.

  • Familiarity with Multiple Employer Plans and Pooled Employer Plans.

 

A successful candidate will have strong academic credentials from a nationally recognized law school, exceptional research skills, analytical and writing abilities, outstanding interpersonal and problem-solving skills, and must work well within a collaborative team.

 

This opportunity can be fully remote, but candidates must be licensed to practice in their home jurisdiction. Licensure in California would be a plus but is not required.
