The case brought against the state-run automatic retirement program known as “CalSavers” has come to a halt after the U.S. Supreme court declined to hear a request by the group has finally been struck down. On February 28, 2022, the Supreme Court declined to hear the case. The Howard Jarvis Taxpayers Association had alleged that the California program was preempted by the Employee Retirement Income Security Act, the federal program enacted back in 1974.
This case has been viewed as critical to the national issue of state-run programs as there are already as many as 14 states that have similar programs and around 45 more have expressed interest in similar mandated retirement programs.
